2. Consent to Public Records Criminal Background Check
As part of our commitment to maintaining the safety and integrity of our community & the public, you agree to undergo a public records criminal background check conducted by or on behalf of Be Formidable, LLC. This check may include:

Public Court Records.

Public Criminal History and Records.

Public Police Records.

Important Notes:

• The background check will only utilize publicly available records.
• Be Formidable, LLC will handle all information obtained during the background check in strict confidence and in compliance with applicable laws and regulations.
• A clear background check is a prerequisite for participating in certain training programs or events.

3. Data Privacy
Your personal information will not be sold.  It will be collected and used for the purposes of communicating with you about our products, services, billing and other membership related issues.  Reference the Consent to Contact section for related policies. By agreeing to these Terms and Conditions, you acknowledge and accept the practices described therein.

4. Dispute Resolution
Any disputes arising under these Terms and Conditions will be resolved in accordance with the governing laws of the state of Indiana.

4. SMS Text Message Communications

We do not send unsolicited SMS text messages.  We do not use SMS text for unsolicited mass marketing, and we do not share or sell your phone number to third parties for marketing purposes.

We will only send you a SMS text message when you provide authorization to us by either:

a)    Explicitly opting in through our contact form (selecting SMS Text and checking the confirmation box), or
b)   Responding “YES” to an opt-in message from us, or
c)    Initiating contact by texting us first requesting a reply. 

With one or more of the above, you provide express consent to receive SMS text messages from Be Formidable, LLC. These messages may include: Appointment confirmations, reminders, account status or customer service related messages.  Message frequency may vary based on your interactions with us.
